Shipping
Got Cheers always strives for an early or on time delivery FOR your celebrations and gifting needs. Got Cheers does not promise date-specific deliveries. Got Cheers is not responsible for late deliveries, due to carrier issues, weather delays, heavy volumes of seasonal package deliveries, natural disaster, and for any other seen or unforeseen issue.
Shipping Weather Holds
Due to extreme hot or cold weather conditions, shipments (excluding Next Day Air) may be delayed. These holds are necessary to protect the integrity of your products and ensure they arrive in excellent condition. While we understand this may cause delays—especially around holidays or special occasions—this precaution helps prevent weather-related damage during transit.
Disputes
Please contact our Consumer Service team with any concerns by utilizing the Contact page on this Site. Any disputes and claims between us that cannot be resolved by our Consumer Service team will be resolved in accordance with this dispute resolution provision.
Any dispute or claim related in any way to your use of or otherwise arising out of our Site, including any products purchased through our Site or your participation in any promotional activities or social media, will be resolved by binding arbitration rather than in court, except as specified below. Claims for public injunctive relief (as defined by law) are not subject to this mandatory binding arbitration provision. Similarly, in lieu of arbitration, you may assert claims in small claims court having jurisdiction if your claims qualify.
There is no judge or jury in arbitration and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages).
You may opt out of these dispute resolution procedures by emailing wine@Got Cheers.com to request the opt out form. Your completed opt out form must be received by Got Cheers within 30 days of the date when you first accept these Terms of Use, or it will not be valid.
The arbitration will be conducted by the American Arbitration Association (AAA) under the AAA’s Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes (collectively, the “AAA Rules”). The AAA Rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA Rules. Got Cheers will reimburse those fees for claims demanding less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Got Cheers will not seek attorneys’ fees and costs in arbitration unless the arbitrator determines the claims are frivolous. Unless we agree otherwise, the arbitration hearing will take place in the county of your billing address.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial and agree that such claim may be brought only in the state and federal courts located in Sacramento County, California. This provision will survive any termination of these Terms of Use.
Governing Law and General
The Federal Arbitration Act, applicable federal arbitration laws and the laws of the State of California, USA, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Got Cheers.
These Terms of Use, and the other policies posted on our Site, constitute the entire agreement between us regarding our Site. Got Cheers’s failure to exercise any right under these Terms of Use does not operate as a waiver of such right. All section titles are for convenience and do not affect the meaning of any provision. All uses of “including” or “includes” may not be interpreted as limiting. If any provision is unlawful, void or unenforceable, that provision is deemed severable and will not affect any remaining provision.

Credit Card Processing Unsuccessful Terms of Use
If a shopper or an existing customers’ credit card is declined or refused as payment, for any reason, Got Cheers will send an email notification to the GC Customer-email on the customer account profile to make other payment arrangement(s). However, if for any reason, the email communication is not received or not responded to in a timely manner all orders will be canceled, and any annual wine clubs for customers and/or recipients will be terminated. All re-confirmed payments will be assigned a confirmation and/or order number immediately upon order update completion.
Fanciful Labeling Terms of Use
Label Designs, especially the Collector tier labels, may change annually. While ever attempt is made to keep all Site materials current, it is entirely possible that a wine label shown on this Site or any promotional materials may be materially different than the design(s) that arrive on the wines you or your recipients purchase and/or receive. An additional reason for the difference between wine label designs shown on this website, and those that are shipped, maybe for the element of surprise and delight when a new GC label design is created and/or shipped. Got Cheers Label designs are planned and arranged internally within the Company newly each year. Wine club subscriptions will automatically be sent the new label design without any communication to the customer or the recipient of GC Wines. Not all GC Collector label designs are changed annually. However, often the GC label designs that DO CHANGE ANNUALLY may include, but are not limited to these occasions/events: Christmas, Holidays, Mother’s Day, Spring/Easter, July 4th/Summer, New Year’s, Thanksgiving/Autumn, and others.
Notice-1: Due to customer demand, label designs may be repeated in future years and/or a classic, always available, label design option may be provided. GC works to have all label designs and revisions be appropriate and tasteful. Most all customers enjoy this fresh, label revision process. If however, a customer or recipient is unhappy or dislikes a particular label design, Got Cheers is unable to provide a refund for any of these reasons.
Notice-2: Label design revisions are an integral part of the Company’s business model. However, Company wine labels are customized in a generalized occasion way. Due to diversity of cultures and preferences, the Company often selects those occasions and events that are prominent celebrations. The exclusion of any event or occasion is not intended for any bias, harm, or neglect in any way.
Notice-3: Personalized label designs with requested names, dates, photos, etc. are available for an additional fee. Please contact the company for details.
